Personal data processing policy

1. general provisions

1.1. This Personal Data Processing and Protection Policy of Ty Concrete LLC (hereinafter referred to as the Policy) is a document that defines the principles of Ty Concrete LLC's activities in processing and protecting personal data, the grounds, purposes, and protective measures taken by Ty Concrete LLC (hereinafter referred to as the Operator).

1.2. The policy is developed in accordance with the requirements of Federal Law No. 152-FZ of 07/27/2006 "On Personal Data" (hereinafter referred to as the Personal Data Law) and defines the procedure for processing personal data and measures to ensure the security of personal data taken by T Concrete LLC. This Policy is subject to placement on the official website of T Concrete LLC: https://tconcrete.ru.

1.3. The Operator's most important goal and condition for carrying out its activities is to respect the rights and freedoms of man and citizen when processing his personal data, including the protection of rights to privacy, personal and family secrets.

1.4. This Operator's Policy on Personal Data Processing applies to all information that the Operator may receive about visitors to the website https://tconcrete.ru, contact details in instant messaging programs (official messengers), social media contact details, as well as from other sources related to the Operator's activities (hereinafter referred to as Sources).

1.5. The collection of data using cookies is regulated by a separate document – the “Cookie Policy,” available at the following link: Cookie Policy.

2 Basic concepts used in the policy

2.1. Automated processing of personal data — processing of personal data using computing tools.
2.2. Blocking of personal data - temporary cessation of the processing of personal data (except in cases where processing is necessary for the clarification of personal data).
2.3. Website - a collection of graphic and informational materials, as well as computer programs and databases, ensuring their accessibility on the internet at the network address https://tconcrete.ru/.
2.4. Personal data information system - a set of personal data contained in databases, and the information technologies and technical means that ensure their processing.
2.5. Anonymization of personal data - actions as a result of which it is impossible to determine the attribution of personal data to a specific User or other data subject without the use of additional information.
2.6. Personal data processing: any action (operation) or a set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.
2.7. Operator: a state body, municipal body, or legal or natural person that independently or jointly with other persons organizes and/or carries out the processing of personal data, and also determines the purposes of personal data processing, the composition of personal data subject to processing, and actions (operations) performed with personal data.
2.8. Personal Data — any information relating directly or indirectly to an identified or identifiable User from the Sources.
2.9. Personal data permitted by the personal data subject for dissemination means personal data to which access by an unlimited number of persons is granted by the personal data subject by giving consent to the processing of personal data permitted by the personal data subject.
3. For distribution in the manner prescribed by the Personal Data Law (hereinafter referred to as personal data authorized for distribution).
2.10. User - any visitor to the Sources.
2.11. Provision of personal data - actions aimed at disclosing personal data to a specific person or a specific group of persons.
2.12. Disclosure of personal data means any actions aimed at disclosing personal data to an indefinite number of persons (transfer of personal data) or at making personal data accessible to an unlimited number of persons, including the publication of personal data in the mass media, placement in information and telecommunication networks, or providing access to personal data in any other way.
2.13. Cross-border transfer of personal data: the transfer of personal data to the territory of a foreign state to a foreign government body, foreign individual, or foreign legal entity.
2.14. Destruction of personal data - any actions as a result of which personal data are irrevocably destroyed, making it impossible to further restore the content of personal data in the personal data information system and (or) material media of personal data are destroyed.

3. Operator's Primary Rights and Responsibilities
3.1 The Operator shall have the right to:

In the event that the data subject withdraws their consent to the processing of personal data, the Operator may continue to process personal data without the data subject's consent if there are grounds specified in the Personal Data Law;
• Independently determine the composition and list of measures that are necessary and sufficient to ensure the fulfillment of obligations provided for by the Personal Data Law and regulatory legal acts adopted in accordance with it, unless otherwise provided by the Personal Data Law or other federal laws.
3.2 The Operator shall:
• Maintain the confidentiality of personal data – do not disclose personal data to third parties or distribute it without the consent of the data subject, unless otherwise provided for by federal law.
• Provide the data subject, upon their request, with information regarding the processing of their personal data;
• Organize the processing of personal data in accordance with the current legislation of the Russian Federation.
• Respond to inquiries and requests from data subjects and their legal representatives in accordance with the Personal Data Protection Law;
• Report necessary information to the authorized body for personal data protection upon its request within 30 days of receiving such request;
• Publish or otherwise make the Personal Data Processing Policy available without restriction;
• Taking legal, organizational, and technical measures to protect personal data from unauthorized or accidental access, destruction, alteration, blocking, copying, provision, dissemination of personal data, as well as from other unlawful actions in relation to personal data;
• Cease the transfer (distribution, provision, access) of personal data, cease the processing and destroy personal data in the manner and cases provided for by the Personal Data Protection Law;
• Perform other duties as provided by the Personal Data Protection Law.

4. basic rights and obligations of personal data subjects

4.1 Personal data subjects have the right:
• Receive information concerning the processing of their personal data, except in cases provided for by federal laws. The information is provided to the personal data subject by the Operator in an accessible form, and it must not contain personal data relating to other personal data subjects, except in cases where there are legal grounds for disclosing such personal data. The list of information and the procedure for obtaining it are established by the Law on Personal Data;
• To demand that the operator clarify their personal data, block it, or destroy it if the personal data is incomplete, outdated, inaccurate, illegally obtained, or not necessary for the stated processing purpose, as well as to take legally provided measures to protect their rights;
• To require prior consent for the processing of personal data for the purpose of marketing goods, works, and services;
• Require prior consent for the processing of personal data for the purpose of withdrawing consent to the processing of personal data;
• Appeal unlawful actions or inaction of the Operator in the processing of personal data to the authorized body for the protection of personal data subjects or to court;
• For the exercise of other rights provided for by the legislation of the Russian Federation.
4.2 The subjects of personal data are obliged to:
• Provide the Operator with accurate data about yourself;
Inform the Operator of the clarification (update, change) of your personal data.
4.3. Persons who have provided the Operator with false information about themselves, or information about another data subject without the latter's consent, shall be liable in accordance with the legislation of the Russian Federation.

5. USER PERSONAL DATA PROCESSED BY THE OPERATOR

5.1. The Operator may process the following personal data of the user:

• Other information about themselves that the personal data subject voluntarily provides when sending a request to the Operator via the feedback form on the Operator's website at https://tconcrete.ru.
5.2. The website also collects and processes anonymized data about visitors (including cookie files) using internet statistics services (Yandex.Metrica and others).
5.3. The aforementioned data is collectively referred to as personal data in this Policy.
5.4. The Operator does not process special categories of personal data concerning racial or ethnic origin, political opinions, religious or philosophical beliefs, or sex life.
5.5. The processing of personal data permitted for distribution from among the special categories of personal data specified in Part 1 of Article 10 of the Personal Data Law is allowed if the prohibitions and conditions stipulated in Article 10.1 of the Personal Data Law are observed.
5.6. The User's consent to the processing of personal data permitted for distribution is formalized separately from other consents to the processing of their personal data. In doing so, the conditions provided for, in particular, in Art. 10.1 of the Personal Data Law are observed. Requirements for the content of such consent are established by the authorized body for the protection of the rights of personal data subjects.
5.6.1. The User grants consent for the processing of personal data authorized for distribution directly to the Operator.
5.6.2. The Operator is obliged to publish information regarding the terms of processing, the existence of prohibitions and conditions for the processing of personal data permitted for dissemination to an unlimited number of persons, no later than three business days from the moment of receiving the User's consent.
5.6.3. The transfer (dissemination, provision, access) of personal data that the personal data subject has authorized for dissemination must be terminated at any time at the request of the personal data subject. This request must include the personal data subject's last name, first name, patronymic (if any), contact information (phone number, email address, or postal address), as well as a list of personal data whose processing is subject to termination.
The personal data specified in this requirement may only be processed by the Operator to whom it is sent.
5.6.4. Consent to the processing of personal data permitted for dissemination ceases to be effective from the moment the Operator receives the request specified in clause 5.6.3 of this Personal Data Processing Policy.
5.7. Users can submit requests for the modification, deletion, or updating of personal data to hello@tconcrete.ru. All requests will be processed within 30 (thirty) calendar days.

6. Principles of personal data processing

6.1. Personal data processing is carried out based on the following principles:
• Legality and good faith;
• Alignment of processing purposes with predetermined and legitimate objectives;
• Minimization of data volume and content within the stated objectives.

7. Purposes of personal data processing

7.1 Personal data is processed for the following purposes:
• Informing users (including sending out news and notifications);
• Improving the quality of services provided and feedback;
Fulfillment of contractual obligations to the user.

• Filling out primary statistical documentation in accordance with labor, tax legislation, and other federal laws;
• Implementation of other legitimate purposes directly provided for by the Operator's local normative acts, as well as execution of instructions (directives) from the Operator's management, given within their competence and not contradicting the requirements of Federal Law No. 152-FZ of July 27, 2006 "On Personal Data" and other federal laws.
7.2. Processing of personal data shall be limited to the achievement of specific, predetermined, and legitimate purposes. Processing of personal data that is incompatible with the purposes of personal data collection specified in clause 7.1 of these Regulations shall not be permitted.
7.3. The Operator has the right to send the User notifications about new products and services, special offers, and various events. The User can always opt out of receiving informational messages by sending a letter to the Operator at hello@tconcrete.ru with the subject line "Opt-out of notifications about new products and services and special offers."
7.4. Anonymous User data collected through internet statistics services is used to gather information about User actions on the site, and to improve the quality of the site and its content.

8. Legal basis for personal data processing

8.1. Processing of personal data shall be carried out by the Operator on a lawful and contractual basis, in accordance with the Constitution of the Russian Federation, the Labor Code of the Russian Federation, the Law on Personal Data and other regulatory legal acts, the Constitution of the Russian Federation, the Labor Code of the Russian Federation, the Law on Personal Data and other regulatory legal acts.
8.2. The legal grounds for processing personal data include:
• User's consent to the processing of their personal data;
• employment contracts and civil law contracts concluded with the Subjects;

8.3. The Operator processes anonymized User data if permitted by the User's browser settings (saving "cookies" and using JavaScript technology are enabled).
8.4. The data subject independently makes the decision to provide their personal data and gives consent freely, by their own will, and in their own interest.
8.5. By agreeing to data processing, the user confirms that they have read this Policy.

9. Conditions of personal data processing

9.1. Personal data processing shall be carried out with the consent of the personal data subject to the processing of their personal data, as well as in compliance with the principles and rules stipulated by the Personal Data Law.
9.2. The processing of personal data is necessary to achieve the purposes provided for in clause 7.1. of this Policy, an international treaty of the Russian Federation or a law, to exercise the functions, powers, and duties vested in the Operator by the legislation of the Russian Federation.
9.3. Data processing periods are governed by the purposes of processing and other legal norms.

10. PROCEDURE FOR COLLECTION, STORAGE, TRANSFER, AND OTHER PROCESSING OF PERSONAL DATA

10.1. The security of personal data processed by the Operator is ensured by implementing the legal, organizational, and technical measures necessary for the full fulfillment of the requirements of current legislation in the field of personal data protection.
10.2. The Operator shall ensure the security of personal data and take all possible measures to prevent unauthorized access to personal data.
10.3. The User's personal data will never, under any circumstances, be transferred to third parties, except in cases related to the execution of current legislation or if the personal data subject has given consent to the Operator to transfer data to a third party for the fulfillment of obligations under a civil law contract.
10.4. In case inaccuracies in personal data are detected, the User can update them independently by sending a notification to the Operator's email address hello@tconcrete.ru with the subject "Personal Data Update".
10.5. The period for processing personal data is determined by the achievement of the purposes for which the personal data was collected, unless otherwise provided by contract or current legislation.
The user can withdraw their consent to the processing of personal data at any time by sending a notification to the Operator via email to the Operator's email address hello@tconcrete.ru with the subject line "Withdrawal of consent for personal data processing."
10.6. All information collected by third-party services, including payment systems, communication services, and other service providers, is stored and processed by said parties (Operators) in accordance with their User Agreement and Privacy Policy. The personal data subject and/or User is obliged to familiarize themselves with said documents in a timely manner. The Operator is not responsible for the actions of third parties, including the service providers mentioned in this clause.
10.9. The Operator shall store personal data in a form that allows the identification of the data subject for no longer than required by the purposes of personal data processing, unless a storage period for personal data is established by federal law, an agreement to which the data subject is a party, or an agreement where the data subject is the beneficiary or guarantor.
10.10. The grounds for termination of personal data processing may include the achievement of the purposes of personal data processing, the expiration of the consent of the personal data subject or the withdrawal of consent by the personal data subject, as well as the detection of unlawful personal data processing.

11. LIST OF ACTIONS PERFORMED BY THE OPERATOR WITH THE OBTAINED PERSONAL DATA

11.1. The Operator shall collect, record, systematize, accumulate, store, clarify (update, change), extract, use, transfer (distribute, provide, grant access to), depersonalize, block, delete, and destroy personal data.
11.2. The operator carries out the automated processing of personal data with the receipt and/or transmission of the obtained information via information and telecommunication networks or without such transmission.

12. cross-border transfer of personal data

12.1. Transfer of data outside the Russian Federation is permitted, provided that data protection guarantees are complied with in accordance with the requirements of the legislation of the Russian Federation.
12.2. Prior to commencing the cross-border transfer of personal data, the operator must ensure that the foreign state to which the personal data is intended to be transferred provides adequate protection of the rights of personal data subjects.
12.3. Cross-border transfer of personal data to the territory of foreign states that do not meet the above requirements may be carried out only if there is written consent from the data subject for the cross-border transfer of their personal data and/or the performance of a contract to which the data subject is a party.

13. Confidentiality of personal data

13.1. Data confidentiality is maintained at all stages of processing.
13.2. Third parties may access data only with the consent of the data subject or as otherwise provided by law.
13.3. The Operator and other persons who have gained access to personal data are obliged not to disclose personal data to third parties and not to disseminate personal data without the consent of the data subject, unless otherwise provided for by federal law.

14. Final provisions

14.1 The User may obtain any clarifications on issues of interest concerning the processing of their personal data by contacting the Operator via email at hello@tconcrete.ru.
14.2. This Policy will reflect any changes to the Operator's personal data processing policy. The Policy is valid indefinitely until replaced by a new version. Users will be notified of significant changes to the Policy through the website or other means of communication.
14.3. The Operator is entitled to make changes to the Policy. The current version of the Policy is freely available on the Internet at https://tconcrete.ru/privacy-policy.
